A Trademark is a word, phrase, symbol, and/or design that identifies and distinguishes the source of the goods of one party from those of others.
The primary function of trademark is to increase to identify the traders and to tell consumers that the goods or services bearing trademark are come form a distinguish source.
There are two types of trademark: trademark (for goods) and service mark.
The common signs used for trademark are : ® và ™. However, there is one difference in usage between them:
® indicates that the mark is registered trademark and protected under trademark laws.
™ shows that the mark is being used as a trademark but not registered trademark or protected under trademark laws.
Although it is not compulsory for companies to register a trademark in order to use it, a trademark registration will bring them various benefits:
Step 1: Identify class of goods/services.
Before fill in the trademark application form, an applicant has to decided what class your goods/services belong to. According to the International Classification of Goods and Services (ICGS), goods and services are classified from classes 1 to 45 (classes of goods: 1-34 and classes of service: 35-45)
The applicant should ensure that they fill the correct class in the trademark registration form. In case the applicant deals in a wide range of goods or services, they should fill more than one class.
Step 2: Self-search for possible conflicts
Because the application fee for registering trademark is not refundable, the applicant must conduct a search for trademark they intend to used in the Singapore Registry of Trademark before filling the applcation form. The purpose of this step is to ensure that there are no prior trademark that is similiar or identical to the one we intend to registry (especially in the area of your business).
Step 3: Application filling
After finishing step 2, the applicant fill in the form and make sure that you use correct class. Then, you send the application form to IPOS and waiting for their examination.
Step 4: Advertisement for public scrunity
Before sending the Trademark Registration Certificate, IPOS will inform the applicant the Acceptance Letter. At the same time, the application will be published on the Trade Marks Journal. If there is objections within two months from the day of publication, your trademark is succesfully registered.
Step 5: Examination for conflicts with existing trademarks
After completing the above step, the Registrar will conduct a official search for the conflicting marks. If there are no identiacal or familiar trademarks as well as no conflictions with Tradamark Act, they will conduct the next step.
Bước 6: Quảng bá trademark
Sau khi hoàn thành việc kiểm tra nhãn hiệu, quý doanh nghiệp sẽ nhận được thông báo chấp thuận đăng ký trademark. Cùng với đó, đơn đăng ký trademark của quý doanh nghiệp sẽ được xuất bản trên tờ tạp chí trademark (Trade Marks Journal). Nếu trong vòng 2 tháng sau khi xuất bản tờ tạp chí mà không nhận được bất kỳ sự phản đối từ các doanh nghiệp khác, thì cơ quan đăng ký trademark Singapore sẽ tiến hành bước cuối cùng.
